By enrolling and participating in The Kasih Rewards Program ("the Program"), you ("the Member," "you") agree to these Terms & Conditions. This document forms a binding agreement between you and The Kasih Villas & Spa ("we," "us," "our").
GENERAL PROGRAM PROVISIONS
Program Operation
The Kasih Rewards Program and its benefits are offered at the sole discretion of The Kasih Villas & Spa. The Program is operated exclusively through The Kasih App. The Kasih Villas & Spa retains ultimate authority over all aspects of the Program.
Program Modification and Termination
The Kasih Villas & Spa reserves the right to modify the Program’s structure, benefits, features, and these Terms & Conditions, or to terminate the Program entirely, at any time, with or without notice, at its sole discretion.
Participating Partners
Points may be earned through qualifying transactions with The Kasih Villas & Spa and our recognized Participating Partners. A current list of partners is available in The Kasih App and includes:
The Kasih Villas & Spa is not liable for changes to or discontinuation of any partner's services or products. We reserve the right to amend the partner list at any time.
Interpretation of Terms
All interpretations of these Terms & Conditions shall be at the sole and absolute discretion of The Kasih Villas & Spa. The decision of The Kasih Villas & Spa is final and binding.
Governing Language
In the event of any discrepancy between the English version of these Terms & Conditions and any translation, the English version shall prevail.
Account Security
Members are responsible for creating secure account access credentials and maintaining their confidentiality. The Kasih Villas & Spa is not liable for any unauthorized access to a member's account, unless such a breach is a direct result of our negligence.
If you become aware of any fraudulent activity on your account, you must report it to The Kasih Villas & Spa Member Services within six (6) months of its occurrence. You must provide all requested information and cooperation to be eligible for the potential reinstatement of lost Points or Rewards, which is granted at our sole discretion.
MEMBERSHIP AND ACCOUNT MANAGEMENT
Membership Eligibility and Enrollment
Membership is available to individuals aged 18 years or older. Corporations, groups, and other legal entities are not eligible. Enrollment must be completed via The Kasih App. Upon successful enrollment, a digital membership card and Member Number will be issued.
Membership Accounts
A member may only hold one account. Joint accounts are not permitted. If a duplicate account is discovered, The Kasih Villas & Spa reserves the right to merge the accounts. When merging, points from the duplicate account will be transferred to the primary (earlier) account, but any status, promotions, or benefits specific to the duplicate account may be forfeited.
Points Value and Transferability
Membership and Points have no cash value and may not be sold, bartered, or transferred, except as explicitly stated herein.
In the event of a member's death, accumulated Points may be transferred to another active member's account upon our receipt and approval of required legal documentation. The request must be made within one (1) year of the member's death. This transfer is at the sole discretion of The Kasih Villas & Spa.
Membership Status: Active & Inactive
An account becomes "Inactive" after twenty-four (24) consecutive months without a qualifying transaction. All points in an Inactive account will be permanently forfeited if the account is not reactivated within the following twelve (12) months. An account can be reactivated by completing a new qualifying transaction. Forfeited points will not be reinstated.
Membership Suspension and Termination
The Kasih Villas & Spa reserves the right to suspend or terminate a member's account without notice if we suspect, at our sole discretion, that the member has:
Termination will result in the immediate forfeiture of all accumulated points and cancellation of all benefits.
EARNING POINTS
Eligibility Condition for Earning Points
To be eligible to earn points, a member must make a booking directly through The Kasih App. This includes booking accommodation or any of the activities offered in the app.
Qualifying Transactions
Members can earn points on the following "Qualifying Transactions":
Earning Process
To earn points, a member must provide their Membership Number at the time of booking or payment. The bill must be in the member's name, and the member must personally pay for all charges. No points will be awarded for "no-show" situations, even if the credit card is charged. A member's account cannot be used by anyone else to earn points. Points are awarded based on the net amount spent and are not earned on taxes, service charges, gratuities, or resort fees.
Missing Points / Retroactive Credit
If a member believes their account was not credited with the correct number of points for a qualifying transaction, they must submit a request for retroactive credit to Member Services within thirty (30) days of the transaction date. The request must be accompanied by a copy of the final, paid bill. Requests are subject to verification and approval at our sole discretion.
REDEEMING POINTS
Reward Redemption
Members can redeem points for various rewards ("Rewards"), including but not limited to complimentary nights, and vouchers for spa, food, and beverage services at The Kasih Villas & Spa and Participating Partners. All redeemed vouchers or rewards are valid for a specific period, as stated on the reward itself, and will expire if not used within that timeframe. Rewards may not be combined with any other discounts, promotions, or special offers unless explicitly stated otherwise.
Redemption Process
All redemptions must be initiated through The Kasih App. The number of points required for a specific Reward is listed in the App and is subject to change.
Reward Availability
All Rewards, especially complimentary nights, are subject to availability at the time of booking and may have blackout dates. Redeemed Rewards are non-refundable, non-exchangeable, and have no cash value. Once points are redeemed for a Reward, the transaction is final.
LEGAL AND PRIVACY
Communications
By enrolling in the Program, you consent to receive administrative communications related to your membership, including statements, program updates, and special offers, via email or notifications within The Kasih App.
Data Privacy
We are committed to protecting your privacy. The collection and use of your personal data within the Program are governed by our main Privacy Policy, which is available for review in The Kasih App and on our website.
Waiver
Our failure to enforce any provision of these Terms & Conditions shall not be construed as a waiver of our right to enforce that provision or any other provision in the future.
Limitation of Liability
The Kasih Villas & Spa will not be liable for any loss or damage, whether direct or indirect, resulting from the termination of or change in the Program or any of its benefits. By participating, members release The Kasih Villas & Spa, its affiliates, and its partners from all liability in connection with the Program.
Dispute Resolution
These Terms & Conditions are governed by and shall be construed in accordance with the laws of Indonesia. Any dispute arising out of or in connection with the Program shall be subject to the exclusive jurisdiction of the courts of Denpasar, Bali.
